Welcome to Apex Path. These Terms of Service ("Terms") govern your access to and use of the Apex Path mobile applications, web application, and all related services (collectively, "the Service"), operated by Rafael Badalov, an individual based in the Republic of Azerbaijan ("Apex Path", "we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to create an account. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service and to agree to these Terms.
You must not be prohibited from receiving the Service under the laws of your country or under any applicable sanctions or export-control regime.
2. Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate, current information when registering, and keep your account details up to date.
- You may not share your account with others, sell it, or transfer it.
- You are responsible for all activity that occurs under your account.
- If you notice unauthorized access, contact us immediately at [email protected].
We may suspend or terminate your account if you violate these Terms, engage in abusive or fraudulent behavior, or if we are required to do so by law.
3. Free Plan and Pro Subscription
The Service offers a Free plan and a paid "Pro" subscription. Feature differences are described on our Pricing page.
3.1 Free Plan
The Free plan includes limited use of the Service, including a daily cap on focus and quick-solve sessions, a monthly cap on AI code reviews, restricted statistics history, and access to a subset of capstone projects. The specific limits are shown in-app and on our Pricing page, and may be adjusted from time to time with prior notice.
3.2 Pro Subscription
Pro is a paid subscription that removes most Free-plan limits and unlocks additional features. Pro is offered as:
- Monthly plan — $4.99 per month, billed monthly.
- Yearly plan — $39.99 per year, billed annually (approximately 33% savings vs. monthly).
Prices are shown in United States dollars. Actual charges may be shown in your local currency, and applicable taxes may be added, depending on your billing provider and your location.
3.3 Auto-Renewal
Pro subscriptions automatically renew at the end of each billing cycle for the same term at the then-current price, unless you cancel before the renewal date. You will be charged through your original payment method.
3.4 Cancellation
You may cancel your Pro subscription at any time:
- Mobile app subscriptions — cancel through the App Store or Google Play, per the platform's cancellation flow. Cancellation takes effect at the end of the current billing cycle.
- Web subscriptions (Paddle) — cancel through the Paddle customer portal linked from the Billing page in your account, or by emailing us. Cancellation takes effect at the end of the current billing cycle.
After cancellation, you retain Pro features until the end of the paid period. You will not be charged again unless you resubscribe.
3.5 Price Changes
We may change subscription prices from time to time. If we do, we will give you at least 30 days' notice by email and inside the app before the new price applies to your renewal. If you do not agree with the new price, you may cancel before the next renewal.

4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the Service, other user accounts, or backend systems
- Interfere with, disrupt, or overload the Service, or attempt to reverse-engineer, decompile, or disassemble any part of it (except to the extent this restriction is prohibited by law)
- Use bots, scripts, or automated means to access the Service or to earn XP, badges, or other in-app rewards
- Submit malicious code, malware, or content designed to harm the Service or other users
- Harass, abuse, threaten, or defame other users through friend requests, chat features, or any communication tool provided by the Service
- Impersonate any person or entity, or misrepresent your affiliation with them
- Attempt to game or manipulate leaderboards, streaks, XP, or crystal balances by fraudulent means
- Sell, transfer, or trade in-app items, crystals, or account access
- Scrape, harvest, or otherwise systematically extract data from the Service without our written permission
We reserve the right to remove content, suspend accounts, and pursue legal remedies for violations of these Acceptable Use rules.
5. User Content
5.1 Your Code and Submissions
You retain all rights to the code you write and submit through the Service. By submitting code and other content ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to store it, display it back to you, run it through automated verification and code-review systems, share it with the third-party service providers listed in our Privacy Policy strictly for the purpose of providing the Service, and use it in anonymized, aggregate form to improve the Service.
We do not use your submitted code to train machine-learning models beyond the scope of providing you with the AI code review feature.
5.2 Content You Send to Other Users
Any content you send to other users through friend requests, activity feed events, chat, or other communication features is your responsibility. You represent that you have the right to send it and that it does not violate these Terms or any third-party rights.
5.3 Our Content
The Service, including course content, concept lessons, exercises, capstone project instructions, artwork, badges, cosmetics, and software, is protected by copyright, trademark, and other intellectual-property laws. Except for the limited rights we grant you under these Terms, we and our licensors reserve all rights.
You may not:
- Copy, reproduce, modify, distribute, or publish our content outside of the Service
- Remove any copyright, trademark, or proprietary notices
- Use our name, logo, or trademarks without our prior written permission
6. Third-Party Services and Integrations
The Service integrates with third-party services (Google, GitHub, App Store, Google Play, Paddle, RevenueCat, and others). Your use of those services is subject to their own terms and policies. We are not responsible for third-party services, but if you have concerns about our integration with a specific provider, contact us.
If you connect your GitHub account or install our GitHub App, you grant us access only to the repositories and events you authorize. You can revoke access at any time from your GitHub settings.
7. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, to the fullest extent permitted by law.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The Service will meet your specific requirements or expectations
- Any content, lessons, or exercises are accurate, complete, or current
- Defects will be corrected
The educational content offered by the Service is intended for skill practice and is not professional certification or a substitute for accredited education. Job outcomes, salary changes, or interview performance depend on many factors outside our control.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, or business interruption) arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
- Our total aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
9. Indemnity
You agree to indemnify and hold us, our officers, directors, employees, contractors, and licensors harmless from any claim, demand, damage, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any law or the rights of any third party.
10. Termination
You may stop using the Service at any time and delete your account from within the app or by contacting us.
We may suspend or terminate your account, with or without notice, if:
- You violate these Terms or the Acceptable Use rules
- We are required to do so by law
- Continuing to provide the Service to you would create a security, legal, or reputational risk
- The Service is discontinued (in whole or in part)
Termination does not entitle you to a refund of any amounts already paid, except as required by the Refund Policy or applicable consumer-protection law.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.
11. Changes to the Service
We may add, change, or remove features at any time. If we make material changes that materially reduce the functionality of the Pro subscription for which you are paying, we will notify you and offer you a pro-rata refund for the unused period at your election.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law; Dispute Resolution
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-laws principles.
You and Apex Path agree to first attempt to resolve any dispute informally by contacting us at [email protected]. If we cannot resolve the dispute informally within 60 days, the dispute will be resolved in the competent courts of the Republic of Azerbaijan, unless applicable consumer-protection law grants you the right to bring proceedings in the courts of your country of residence.
Nothing in these Terms limits your statutory rights as a consumer under the laws of your country of residence.
14. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger or acquisition.
- Force majeure. We are not liable for delay or failure to perform caused by events beyond our reasonable control.
- Language. These Terms are provided in English. Translated versions are for convenience only; the English version governs in case of conflict.
